코로나 바이러스 때문에 많은 분들이 힘들 이 시기에 렌트 security deposit 을 일부만 돌려받은 1인 입니다 ㅠ (지역은 캘리포니아 LA 카운티 입니다)

지난 2월에 이사 나오면서 깨끗하게 청소까지 마치고 나왔는데 (다행히 청소 마치고 나가기 전에 사진은 찍어두었어요) 3월에 cleaning 과 painting 명목으로 각각 $295 와 $585 나왔다고 청구서를 첨부해서 그만큼을 제하고 deposit 을 돌려받았어요.

그래서 이메일로 항의했더니 re-rental standards 에 맞추기 위해서 cleaning 과 re-painting 을 했고 그건 ordinary wear and tear 가 아니라고 하네요.

 

 

처음 들어올 때 오래된 집이라도 깔끔하게 페인팅 되어 있어서 좋았는데 지금 찾아보니 이 회사 리뷰에 나갈 때 무조건 cleaning 하고 painting 으로 charging 한다고 악평이…ㅠ

캘리포니아 security deposit 관련된 Civil Code (§ 1950.5(e))를 찾아보니 ordinary wear and tear 를 청구할 수 없다고 하는데 cleaning 과 painting 은 ordinary wear and tear 가 아닌건가요?

법원 사이트 (https://www.courts.ca.gov/selfhelp-eviction-security-deposits.htm?rdeLocaleAttr=en) 에도

"The cost of cleaning the unit when the tenant moves out, but only to make the unit as clean as it was when the tenant first moved in (less reasonable wear and tear)"

"The landlord can withhold from the security deposit ONLY those amounts that are necessary and reasonable, and NOT a result of “ordinary and reasonable wear and tear." For example, a landlord may not make tenants pay for painting, new carpets, or curtains unless they are damaged beyond ordinary and reasonable wear and tear."

이렇게 나와있어서 다시 한번 이메일 보내고 그거에 대한 답이 없어서 demand letter 양식 받아서 4/10 까지 돌려달라고 certified mail 로 보냈는데 계속 무소식이네요.

정녕 small claims court 에 sue 하는 방법 밖에 없나요?

여지껏 경찰서/법원 이런 곳 한번도 가본 적이 없어서 막연한 두려움(?) 이 있는데 경험이라고 생각하고 부딪혀 봐야 할까요? 아님 돌려받을 수 있는 다른 alternate 한 방법이 있을까요?
