This H2O Wireless Trivia Contest (“Contest”) is open only to legal residents of the 50 United States and District of Columbia (excluding its possessions and territories), who are at least eighteen (18) years of age as of the time of entry. Employees, agents or officers of H2O Wireless (“Sponsor”) or of any entity involved in the development, production, implementation and distribution of the Contest, including any advertising or promotion agency, supplier of prizes for the Contest, parent company, service provider, subsidiary or affiliate of any such entity or any other entity directly associated with the Contest or any member of the immediate family of and/or person living in the same household as such persons, are ineligible to enter the Contest. The Contest is void where restricted or prohibited by law.

The Contest will begin on May 19, 2014 at 12:00:01 a.m. EST and will end on October 1, 2014 at 11:59:59 p.m. EDT (“Contest Period”). The Contest will run in consecutive two week periods (“Two Week Period”) during the Contest Period with each two week period beginning every other Monday. The first phase of the contest will begin on Monday May 19, 2014 at 12:00:01 a.m. EST and will end on Friday, May 16 at 11:59:59 p.m. EDT and will be held the following Mondays at 12:00:01 a.m. EST through Fridays at 11:59:59 p.m. EDT of every other week (“Phase One”). During Phase One, participants must complete an entry form and correctly answer the trivia question on Sponsor’s website (“Phase One Entry”). On the following Monday, a drawing will be held from all correct Phase One Entries, and the contestant whose name is drawn will be given two tickets to a New York Mets home game as well as an opportunity to participate in another sports trivia contest on “The Tailgate” radio program on WOR 710 against Terrance “T Bone” Campbell (further details provided in Section 4) (“Phase Two”). The participant can participate either in studio or via phone on Wednesday following the drawing and must correctly answer more than or the same number of questions as T Bone in order to receive a $100 Visa gift card. Phase One will begin again on the following Monday at 12:00:01 a.m. EST and the two week cycle will repeat until the end of the Contest Period. 

(a) To enter during Phase One of the Contest, participants must complete the entry form and correctly answer the trivia question posed on Sponsor’s website at https://23e5d4.campgn5.com/H2O-Wireless--Tailgate-Trivia. 
(b) Only one entry per person. Only one prize per person. No automated entry devices and/or programs permitted. Sponsor is not responsible for lost, late, illegible, stolen, incomplete, invalid, unintelligible, misdirected, technically corrupted or garbled entries, which will be disqualified. Only fully completed entry forms are eligible. Proof of submission will not be deemed to be proof of receipt by Sponsor. 
(c) Entries may not contain references which are obscene, crude or vulgar, and/or which contain gang identification, references to commercial products, license plate numbers, Web site URLs, derogatory characterizations of any ethnic, racial, sexual or religious groups, references to illegal or inappropriate activity, behavior or conduct, or any other references that could be considered inappropriate, unsuitable or offensive, as determined by Sponsor, in its sole discretion.
(d) By entering this Contest, except where prohibited by law, entrants release and hold harmless Sponsor, its representatives, parent company, subsidiaries, affiliates, advertising and promotion agencies, and all its respective employees, officers, directors, representatives and agents from and against any and all claims, actions, demands, liabilities, damages, injuries, losses and costs, expenses and damages of any kind including without limitation punitive, incidental, consequential damages, that may result from participation in the Contest or acceptance or use of any prize. By entering in the Contest, participants agree that they will have no rights to bring (and covenant not to bring) any claim, action or proceeding of any kind or nature whatsoever against Sponsor.  

(a) Phase One Prize. One (1) winner selected from a random drawing of Phase One Entries (“Phase One Winner”) will receive the following: (a) two (2) tickets to a New York Mets home game (“Mets Tickets”); and (b) an opportunity to participate in a trivia contest on “The Tailgate” radio program on WOR 710 against Terrance “T Bone” Campbell (“Radio Trivia”). The Mets Tickets will be to a New York Mets home game of Sponsor’s choosing. The Radio Trivia will consist of a series of sports trivia questions provided by “The Tailgate” and will be held on Wednesday of the week following Phase One. In order to participate in the Radio Trivia, the Phase One Winner must either call in to the radio station to answer the trivia questions or appear in studio on the Wednesday of the week following Phase One, and the Phase One Winner must complete all required paperwork of the WOR 710 radio station. 
 (b) Phase Two Prize. Phase One Winner must either correctly answer more trivia questions than T Bone or must correctly answer the same number of trivia questions as T Bone in order to win the $100 Visa gift card (“Phase Two Winner”). The Radio Trivia will be recorded and will be aired during “The Tailgate” radio show on the Saturday following the Radio Trivia.
(c) Approximate Value of Prizes. The Mets Tickets, the opportunity to participate in the Radio Trivia, and the $100 Visa Gift Card are each known as a “Prize” and together known as “Prizes.” The approximate retail value of the Mets tickets will vary depending on the home game and may range from $50.00 to $200.00 each. The approximate retail value of opportunity to participate in the Radio Trivia is $0. The approximate retail value of the $100 Visa Gift Card is $100. The approximate retail value of the Prizes represents Sponsor’s good faith determination. That determination is final and binding and cannot be appealed. If the actual value of the Prizes turns out to be less than the stated approximate retail value, the difference will not be awarded in cash.
(d) Prizes are non-transferable. No substitutions or cash redemptions. Sponsor reserves the right to substitute the Prize in whole or in part for a prize of equal or greater value in the event that any component of the Prize is unavailable for any reason. Prizes may not be sold, bartered or transferred. Prizes do not include any additional expenses, including, but not limited to incidentals, meals, telephone charges, transportation to and from the Radio Trivia or Mets home game, travel insurance, souvenirs, any other transportation, and federal, state and local sales or other taxes and surcharges which are the responsibility of each winner.
(e) Phase One Winner and Phase Two Winner are each known as a “Winner.” Winning any Prize requires that the Winner of the Prize is, and remains, in compliance with these Official Contest Rules. Winner will be required to sign and return to Sponsor an Affidavit of Eligibility and Liability/Publicity Release (“Winner’s Documents”), except where prohibited by law, by the Tuesday before the Radio Trivia. Phase One Winners may be required by the WOR 710 radio studio to complete additional paperwork If a Winner rejects his/her Prize or in the event of noncompliance with these Contest rules and requirements, such Prize will be forfeited and an alternate winner may be selected.

Phase One Winner will be selected in a random drawing from all eligible Phase One Entries received during Phase One. The random drawing will take place at the executive offices of Locus Telecommunications Inc., 2200 Fletcher Avenue Fort Lee, NJ 07024 on the Monday following the end of Phase One. The odds of winning depend on the number of eligible Phase One Entries received.

The Phase One Winner will be notified by email on the date of the random drawing. If the Phase One Winner does not contact the Sponsor and return the required Winner’s Documents by the next day (the Tuesday after the random drawing), or if the Winner is disqualified for not complying with the Official Contest Rules, the Prize will be forfeited and an alternative winner may be selected in a random drawing from all remaining eligible entries. By entering the Contest, entrants fully and unconditionally agree to be bound by these rules and the decisions of the Sponsor, which will be final and binding in all matters relating to the Contest.
