아멕스가 리턴프로텍션 클레임을 받아들이지 않았습니다.

안녕하세요. 오랜만에 인사드립니다.

다름이 아니고 아멕스에 전자제품을 리턴프로텍션으로 클레임 했었는데 거부당했습니다.

클레임 했던 아이템은 컴퓨터 모니터고, 카드는 SPG 사용했습니다.

구입처는 뉴에그였고, 페이는 paypal를 통해서 amex로 했었습니다.

근데 모니터가 막상 받고보니 크기도 생각보다 작고 여러모로 마음에 들지를 않더라고요.

그래서 뉴에그의 return policy를알아봤더니 15% restocking fee를 붙인다고 해서 아멕스에 return protection을 클레임 했었습니다.

처음에는 아이템이 들어가있는 영수증을 보내달라고 해서 팩스를 보냈더니

몇가지 질문할게 있다고 전화가 왔었습니다.

질문들은 형식적인 것들 이었어요.

예를 들면, 언제 샀느냐. 상태는 어떻느냐. 왜 리턴하려고 하느냐. 

왜 newegg에서 리턴을 안받아주냐. 그럼 받아주긴 하는데 restocking fee때문에 그런거니? 등등..

그리고 리뷰를 한다고 메일이 오고, 일주일뒤인 오늘 이메일을 받았는데 클레임이.... deny 됐다고 합니다.

아래는 메일의 전문입니다.

Thank you for your recent Return Protection claim submission. We are writing to inform you

that your claim has been Closed. Please review the following claims summary for the Claim 

Number referenced above.

Denial(s) on Claim include:

Under the limitations section of Return Protection, it states: ... "Any item purchased from a 

merchant that has an established return/satisfaction guarantee program which is greater than 

or equal to the terms of Return Protection, and provides coverage for claim, will not be 

eligible for a Return Protection Refund." ...

Under the Limitations section of Return Protection, it states, ..."An item is eligible if it may 

not be returned by the Cardmember to the merchant from which it was originally 

purchased."...

Our records indicate that the item you claimed was eligible for exchange or store credit at the 

time the return was attempted, the item is not eligible under the Return Protection Program.

We appreciate your interest in the program and hope you will continue to take advantage of this 

benefit. If you have questions, please call your Return Protection Claims Department at (800) 

297-8019.

In making this denial, AMEX Assurance Company expressly reserves all of its rights and 

defenses under the policy and does not in any way waive any right or defense which the 

company may have. If you have additional information you would like us to consider, please 

forward it to us for review.

Should you wish to appeal this denial or have additional information you would like us to 

consider, please send written explanation as to the basis of your appeal to AMEX Assurance 

Company, attention to Appeals Coordinator, at PO Box 981553, El Paso, TX 79998-9920. 

Once we receive your additional information, we will provide response within 30 days (For 

New Jersey residents, we will provide a response within 10 days).

For your protection California law requires the following to appear on this form: Any person 

who knowingly presents false or fraudulent claim for the payment of a loss is guilty of a crime 

and may be subject to fines and confinement in state prison.

Please be advised that there may be an applicable statute of limitations that may bar your rights 

in the future.
